Afghan Admission Programme - Appeals
Has anyone examined the appeals procedure for this scheme yet? I have a client who was requested to provide further documentary evidence of the familial relationship with the proposed beneficiary within 20 days. It was three days out from this timeframe and rejected. Due to some small anomolies on the documents I suggested DNA evidence and wrote to the Department asking for time to submit this. I was told no further evidence would be considered. It is unclear whether the documents my client submitted (which was late and not accepted) will now be submitted in the appeal. I suppose that argument is going to form the basis of our appeal.
I don’t think I’ve ever been involved in an immigration appeal process where the decision maker expressly states that no new evidence will be considered.
