Post-Brexit marriage to UK national
Hi all, could anyone help clarify the position with regard to UK nationals who were exercising EU Treaty rights in Ireland prior to Brexit but have married after the transition period?
I know generally UK nationals who were exercising Treaty rights here before the end of the transition period retain the Directive rights of EU nationals, but reading Regulation 3(1) of the Withdrawal Regs and Article 10(1)(e) of the Withdrawal Agreement it looks to me like this doesn't apply where the marriage took place after the end of the transition period.
However on the Department's web page for family members of UK nationals who can't avail of Treaty rights, it says that the post-Brexit scheme "only applies when a UK national has come to live in Ireland after 31 December 2020."
Has anyone had a case of this type?
