Can student permission contribute to the 3/4 year requirement under S6(A)1 of the Nationality and Citizenship Act 2004
Hi everyone,
I have a client who is seeking a passport for her son born in the State on 17.11.16. She may need to rely upon a period of 6 months when she was legally in the State on foot of a student stamp 2. The balance of her time in the State has been on a stamp 4.
The DFA are asking that she shows reckonable residency for the 4 years prior to that date.
Their most recent communication to the client reads:
" your child was born on 17/11/2016 . The required reckonable residency is from 17.11.2012 to 16/11/2016.
Is the DFA correct in requiring reckonable residency ( not student time) or can all legal periods of residency be used towards the 3 out of 4 year period.
