Ethnic Chef Work Permit

I have a client who has been working part time as Chef in a Chinese Take Away in accordance with his Stamp 2 student permission. He then obtained the Stamp 1G under the graduate program and this is due to expire shortly. He wishes to continue employment on a full time basis in the Chinese Take Away.


My understanding is that he must now apply for a Work Permit. Chef's are ineligible for General Work Permit save for e.g. Commis Chef etc. with required experience (which he now has) but only in circumstances where he is not employed in a "Take Away".


Has anyone successfully applied for a Work Permit for an Ethnic Chef in a take away? Can anyone shed light on why the Department will not consider a Take Away as opposed to a restaurant given that for the last 2 years a lot of restaurants have been operating as a take away anyway and some still are.


I would be grateful for any guidance.

Hi Wendy, feedback is takeaways are excluded. Basically if food has to be consumed off premises that is there is no where to sit and eat.
