Ukrainians who applied for international protection before the Temporary Protection Directive, or soon thereafter.
For the attention of IILA members
Attached please find correspondence between IILA and the IPO regarding Ukrainian nationals (and other eligible persons of any nationality) who applied for international protection before the Temporary Protection Directive or soon thereafter. The IPO have stated that the withdrawal of an IP application is deemed to be a legal withdrawal under section 37 of the International Protection Act, 2015. This triggers an automatic refusal of refugee and subsidiary protection status. Any subsequent application would require an application under section 22(4) of the International Protection Act, 2015.
