Sports and Cultural Employment Permit

Hello. I'm looking at the refusal of a sports and cultural employment permit where a reason for refusal relates to the Department contacting "the relevant Government Body/ Person concerned" who has decided that the employment the subject of the permit application is not appropriate to the development and operation of sporting or cultural activities in the State. This is so vague a reason. I am wondering if there are guidelines re these permits where we could see what would be appropriate or not, does anyone have any info/ advice on this? Thanks

Hi Helen. My experience is limited to Sports and Cultural permits in the film industry - it was only a handful. For that project however the relevant governing body strongly and explicitly supported the applications and our advice to the client was to ensure they obtained this support / "blessing" prior to the filing. I do agree that a refusal along the lines of what you have received is vague, but the 2024 Act [(s33(9)(b)]seems to give the Minister wide discretion. I do not believe there are published guidelines as to what would be "appropriate" for the Minister. That would be very welcome. To my knowledge this has not been tested but, again, I fear that the discretion given here to the Minister could be problematic. Happy to chat.
